<div dir="auto">It was with the greatest of sadness that I heard that Children Panel Solicitor Brendan Fleming passed away suddenly on 31/12/2023 & Colleague informed me last night 03/01/2023.</div>

<div dir="auto">Brendan was one of a very few Children Panel Solicitors that was dedicated to his Service users& in fact opened his office at weekends and on a Bank Holidays.</div>
<div dir="auto"></div>
<div dir="auto">On a personal basis I could contact Brendan at any reasonable time of night to ask him if his Team could take on a new Family Law Case pertaining to Children Care Proceedings & other related Family Law Proceedings including Applications to the Family Court with reference to Parebtibg Areangements.</div>
<div dir="auto"></div>
<div dir="auto">Brendan had won many cases pertaining to Parents who had been accused of non accidental injury due to unexplained fractures in Babies & Children who were eventually diagnosed with metabolic bone disorders, such as vitamin D deficiency and Osteo Genesis Imperfecta a form of brittle bone disease.</div>

<div dir="auto">There are very few Children Panel Solicitors that specialise in cases where Parents are accused of injuring their Children but Brendan team are one of the very few.</div>
<div dir="auto"></div>
<div dir="auto">Brendan also continued to care deeply about the trauma that his Service Users experienced when having their children wrongly takeen into care by Local Authorities Social Services Departments.</div>
<div dir="auto">Brendan told me that before he became a Children Panel Solicitor he was a Crimibal Law Solicitor so he would of been aware of the Criminal side of where Parebts are wrongly charged in the ceiminal element of these cases.</div>

<div dir="auto">Brendan also used to travel from Birmingham to Leicester to take part in Our Parents Against Injustice Team meetings , which involved us also inviting the Solicitors that agreeed to take our cases as in Legal Representation. where often some solicitors couldn’t turn up the TWO Bs were always there.</div>
<div dir="auto">It will be very hard for parents to get real Justice now that the two best Children Panel Solicitors have died.with Bilk Bache dying very sadly in 2021.</div>
<div dir="auto">One of the Solicitors Team that Bill worked for stated the following about Bill, one of Bills greatest achievements was showing that just because there is no evidence to the contrary, it doesn’t mean that a Parent intentionally inflicted injuries to their child.</div>
<div dir="auto">In My wasopinion both Brendan and Bill dealt with very troubled Service Users with a huge amount of empathy sensitivity and understanding, and you can tell that Brendan was not just in the profession for the money, you can see Brendan sentiments about this ion the Brendan Fleming Solicitor website.</div>

<p>The child experienced injuries and bruising while in foster care.</p>
<p>The Judge seems to think that the Mother was more likely or not to have caused the fractures.</p>
<p>It has also been stated that the injuries could not have been caused by the troublesome birth and a forceps delivery.</p>
<p>The Parents tried to get permission to appeal the Judges Finding of Fact Judgment but were denied.</p>

<p>I have forwarded a Freedom of Information Request to BARTS NHS TRUST via What do they know website with reference to the amount of money they have spent on Legal Fees for Representation of instigating Court Proceedings against the Parents of Child AB.</p>
<p>They deem via evidence given by Medical Staff within the Family Division of the High Court that it would not be in the best interest of Child AB to prolong life support on a ventilator, because he is brain dead, and is only being kept…</p>
<p>I have forwarded a Freedom of Information Request to BARTS NHS TRUST via What do they know website with reference to the amount of money they have spent on Legal Fees for Representation of instigating Court Proceedings against the Parents of Child AB.</p>
<p>They deem via evidence given by Medical Staff within the Family Division of the High Court that it would not be in the best interest of Child AB to prolong life support on a ventilator, because he is brain dead, and is only being kept alive by the ventilator and other medication given IV, and a feed given via NG tube.</p>
<p>The medics also report that AB is not in any pain and is not aware of what is going on.</p>
<p>And with a severe brain injury there is no chance of any recovery whatsoever. thus the Hospital Trust Application to the High Court to terminate life support of AB..</p>
<p>We have seen over the past 5 years that Hospitals are very happy to spend huge amounts of money to terminate the life support of babies that they insist have no chance of any form of recovery from brain disorders and severe brain injuries thus the need for life support via a ventilator, as well as medication and NG feeds.</p>
<p>The issues for debate on this subject here is a big no i am here to disclose the amount of money that Hospital Trusts are prepared to pay in legal fees to terminate the life support of these Children.</p>
<p>Alder Hey Children's Hospital in Liverpool and Great Ormond Street Children hospital in London spent over half a million pounds to terminate the lives of Baby AE and Baby CG.</p>
<p>The Parents involved in these heart breaking Cases are not even allowed Legal Aid to assist with regards to representation within the Family Division of the High Court to fight their Case, in the situation of life and death of their Child.</p>
<p>All Parents highlighted in these Cases have managed to obtain Pro Bono legal representation via a Charity Christian concern based in London.</p>
<p>Child AB mother stated that todays Court hearing was her 15th time in the High Court, in respect of her 12 year old son AB.</p>
<p>The current High Court hearing within the Family Division RCJ was to try and get permission to appeal Lord Justice Haydon Decision that AB should have his life support terminated.</p>
<p>That issue i am not debating here the Rights and Wrongs of the Court Judgment.</p>
<p>The Judge oral Judgement will be made on Monday 24th July 2022 at 11.30am.</p>
<p>This may not be the end of the awful scenario as the Parents could also decide to try and get permission to appeal via the Supreme Court and the ECHR, both scenarios would result in the Hospital Trust having more money out in Legal fees.</p>

<p>Another epic battle where a Hospital Trust decided that they had enough medical evidence to support them in taking the issue to Court where 12 year old AB Parents did not agree that their Childs life support should not be terminated.</p>
<p>Over recent years we have seen how much money Hospital Trusts are prepared to spend on legal representation to support their ambition of terminating life support on seriously ill babies and Children.</p>
<p>The total amount of money paid in legal fees to terminate the lives of Babies Charlie Gard and Alfie Evans was well over a quarter of a million pounds.</p>
<p>I put a Freedom of Information Request into the two Hospital Trusts caring for these babies to get the financial statistics.</p>
<p>Archie was found at home in his bedroom with a ligature round his neck.</p>
<p>He has been on a full life support system since his admission to hospital in May 2022.</p>
<p>A brain Mri scan done on AB in May 2022 revealed that AB was brain dead thus the reason the Trust have taken the issue to Court to terminate life support.</p>
<p>A brain stem test went wrong, so this could not be used as evidence in Court to terminate life support.</p>
<p>The Lady Judge in the Final hearing gave permission for AB life support to be terminated allowing AB to die in dignity.</p>
<p>The Parents put an Application into the High Court at the RCJ to try and get permission to appeal the former Judges decision of termination of life support.</p>
<p>Permission was given, due to the FACT that a Welfare checklist was not done.</p>
<p>The Guardian ad litem involved in the case did not give documented best interest findings regarding AB and his Parents.</p>
<p>And the Guardian did not take the stand in the final hearing.</p>
<p>Thus permission was given for a brand new hearing at the High Court RCJ, in front of Lord Justice Hayden.</p>
<p>we were all there in person and online to see the case law that was breached within the final hearing of AB Parents v Hospital Trust.</p>

<p>I will now have to go and write a stern email to the Data Protection officer within the Hospital Trust stating that due to their breach i could loose my current PIP claim.</p>

<p>With reference to one of our Cases a Mother was accused of causing Parental alienation by the two Girls Father.</p>
<p>Thus we were given ten minutes to find an independent psychologist to assess the Mother, for the so called Parental alienation.</p>
<p>We have a large list of independent psychologists and independent social workers to do assessments within the Family Court Arena.</p>
<p>So we could come up with a psychologists name that specialised in parental alienation.</p>
<p>The Psychological assessment report clearly stated that the Mother had no psychological traits to confirm she was capable of causing any aspects of PAS.</p>

<p>The Childs Mother put in the following issues in her statement to appeal.</p>
<p>Her mother sought to challenge the coroner's ruling dated 8 August 2021 to the effect that the inquest into Kianna's death will not investigate in what circumstances she came by her death, pursuant to section 5(2) of the Coroners and Justice Act 2009, because the procedural investigative duty contained in Article 2 of the European Convention on Human Rights did not arise.</p>
<p>On 24 November 2021 she was granted permission on all her three grounds by Upper Tribunal Judge Grubb, sitting as a judge of the High Court.</p>
<p>Kianna’s mother advanced the following three grounds:</p>
<ol>
<li>The coroner erred in law in concluding that the council did not owe a duty to provide Kianna with accommodation under section 76(1)(c) of the Social Services and Well-being (Wales) Act 2014;</li>
<li>The coroner failed to provide adequate reasons for the finding that no obligation to provide accommodation to Kianna arose under section 76(3) of the 2014 Act; and</li>
<li>His decision that section 5(2) of the Coroners and Justice Act 2009 was not engaged was in breach of section 6 of the Human Rights Act 1998.</li>

<p>Another positive way forward with Children having their own specialised DOLS team within the RCJ.</p>
<p>It would be important to find out if the Court of Protection in these Children's Liberty Protection Safeguarding cases will allow Parents to become an Appropriate Person for their Child under the new Liberty Protection Safeguarding Policy.</p>
<p>An Appropriate Person, under the new system will have to be appointed by the the Responsible Body which will be the Hospital or children's home that the child might be in.</p>
<p>The former might cause problems if the Parents decide to challenge the hospital or put in a complaint into the hospital about poor nursing care.</p>
<p>The Responsible Body may use any complaints the Parents make about the hospital and use complaints as a way not to allow that person to become an Appropriate Persons Advocate or Representative.</p>
<p>With regards to the new LPS system the cared for person and the Appropriate person will only get an IMCA appointed if they request one.</p>
<p>Under the current DOLS policy, Best Interest Assessors carry out assessments in all cases.</p>
<p>Under the new system LPS approved Mental Capacity Professionals AMCPs will come in and assess cases where there is a reason to be believe that the person objects to the arrangements where the child or person is cared for in a independent hospital or where the Responsible body decides to refer for a AMCP.</p>
