Guardians should follow their basic guidelines which means encouraging children to fill in the Cafcas wishes and feelings pack in.

If this is not done the Gillick children are obviously not having their wishes and feelings considered, which could be a breach of their Human Rights under article 8.

.In the UK, human rights are protected by the Human Rights Act 1998. The Act gives effect to the human rights set out in the European Convention on Human Rights. Article 8 - the right to respect for your family and private life, your home and your correspondence is one the rights protected by the Human Rights Act.

PAIN have been present while a child was filling her Cafcass wishes and feelings pack in and have advocated for Children within the family court arena private law cases,

We have also dealt with a High Court Private Law case where Gillick children have been able to see the Judge in Chambers to highlight their wishes and feelings prior to the family court arena.
