MY DATA IS IT SAFE IN THEIR HANDS AFTER THEY HAVE BREACHED THE DATA PROTECTION ACT TWICE IN A YEAR

The Local Authority have breached my Data twice in the last year.
One was the Finance Department at Leicestershire Country Council, the other another Department at the Local Authority dealing with Carers.
Last April i filled in the forms for a Carers Assessment on line.
A Social Worker contacted me, and asked to come to the house and take some details.
I have about 6 long term medical problems, the effect of my medical problems affects the way i care for My Husband on a full time basis.
The Social Worker took my bank details, so the amount could be payed into my bank account by BACS.
Very strange i thought, because they usually forwarded me a cheque.
The money did not ever get put into my bank, no cheque arrived through the letter box even though the Social Worker stated that the letter and cheque was sent out on 24th January 2018.
It took them two weeks to get back to my, i have already blogged about this.
Last Friday the money was put into my bank account by BACS.
Last Saturday afternoon a letter came through the post with the cheque dated 23rd January 2018.
But yet the envelope was dated 27th February 2018, so obviously the letter had been sitting on somebody's desk, and the LA had in fact lied to me when they stated it was sent out on 23rd January 2018.
Anyway i put the cheque through the paper shredder.
I asked the LA to remove my bank details from their data base, because they had breached the Data Protection act regarding myself twice in a year and i did not want the security of my current account compromised.
A letter arrived today stating that they would not be removing my details from their data base.
So now i have to change my bank provider from the NATWEST, because the LA could not guarantee that my bank account details would not be safe.
So there could be a third data protection breach.
I spoke to a Woman on the phone this am, she basically said what the letter stated.
So now i will contact the Local Government Ombudsman, Information Commissioner, and make an appointment to see my MP, as well as my County Councilor and possibly the press.
IN THE MEANTIME MY DATA IS ONCE AGAIN WAITING TO BE COMPROMISED .

Dear Ms Stevens,

Many thanks for your email requesting that we remove your bank account details from the database.

I have been discussing your request with the department and unfortunately we will not be able to delete the information as requested.

Any bank details are recorded in our finance system, Oracle.  We can add an end date to any bank detail to make the account inactive to ensure payments are not made to them going forward but the information is retained in the database.  Even when the account is made inactive, the information is still retained.

Section 9 of the Limitations Act 1980 applies to bank records so the Council needs to have the ability to prove who we have paid as companies or individuals have six years to make a claim.  Our approach at Leicestershire County Council is to retain for 6 years after the current (7 in total).

Therefore we will need to retain the information where payments have been made for 7 years.  This would apply to all suppliers / individuals regardless of the department within the council.

With regards to your record, we have added an end date to your account which means no further payments will be made going forward unless you get in contact with the Council. After the 7 years the details will be deleted in accordance to the legislation.
