How to comply with court rulings on section 20

We tell Our Service Users to never ever sign or agree to sign a section 20 Order, because it means that they will be placing their Children into Voluntary Care.

It also means that you will not be eligible to get get Public Funded Legal Aid at this time.

And they can sit on this order for a good few weeks.

The only problem is, if a Parent does not sign this Order, they will in a lot of Cases is go to Court for an Emergency Protection Order to be granted.

Social Workers do not tell you that you have the right to discharge this Order within 72 hours.

Legal aid will be granted after the EPO has been granted.

If they mention to you that they are going for an Emergency Protection Order, it is vital that you act very quickly.

Some of our Children's Panel Solicitors have been very successful in preventing the granting of these Orders.
