Family cases – To record…..or not to record….that is the question?

The Social Worker knocked the door, she was doing a section 37 report on two Children, with regards to a Private Law case.

There was no Child Protection issues regarding the Mother in this case, who had a Residence Order on the Children.

Both Children were classed as Gillick, even though the youngest Girl was 11, she was classed as Gillick, because she had the cognitive ability of a 13 year old.

The Social Worker was informed that this meeting was going to be recorded, and she was also informed that the Children's Solicitor was going to be present.

The Solicitor had also contacted THE LAW SOCIETY to get further advice, about being there, 

And the Law Society stated that is was totally acceptable for the Solicitor to be present, the Solicitor even informed the Social Worker that he was going to be there, and she stated that there would be no problem.

On being greeted into the house, Social Worker said that she was not happy about the Solicitor being present, and did not want the meeting recorded.

She left the property.

The Children's stated that the Social Worker conduct was abysmal, and he would seriously look into the issues.

Three weeks later the Social Worker arrived with her Manager.

The Children's Solicitor was there again to take notes, and the LA agreed that the meeting could be audio recorded, or the 2 Social Workers gave  their permission to record.

The Judge then saw the Children in Chambers, for them to highlight their wishes and feelings.

There was some recordings made at contact, which was overnight.

The Judge heard these recordings, and i must say that there was some very harmful information via the Father , in the recordings, relating to the Judge himself, and harmful events regarding the Father, what he was doing and saying to his Girls.

RESULT CONTACT STOPPED WITH THE Father instantly.

Mother, subject to domestic violence, for quite a few years, Girls put through harrowing and unacceptable events while going through contact.

RECORDING WORKED IN THIS CASE FOR THE BETTER.

IN THIS CASE I MUST SAY THE CHILDREN CONTACTED THE SOLICITOR BY THEMSELVES.

The Children also filled the Cafcass wishes and feelings pack in with an ADVOCATE at their home, which was forwarded to the Court.

THE CASE WAS WON BY OUR SERVICE USER.
