FROM A GRATEFUL PAIN CLIENT AFTER THEIR CASE WIN-I JUST HAD TO SHARE

It was good to speak to you this evening, and after about half a year eventually some good news to pass on that no charges were made against me and all children
were removed from any CP/CIN plan after the second case meeting. I forgot to say
that Rose's hand did completely heal without scaring and all of our children
are doing well
J



It has been the most horrendous ordeal our family has had to suffer, the most shocking thing has been how just one "professional" was able to
misguide and propagate a series of lies that has taken so long to unravel. It
soon became clear to CYPS that my wife was not depressed nor I had intended to
cause the injury, yet we were treated as guilty, threatened to have our
children taken from us (actually said in front of one of them!) and the
assumption was made that we were a danger to our children.



What we did not realise at the time is that they don't actually need any evidence whatsoever to take children from parents, but only need to be concerned that
the children could be at risk in the future “in their opinion”.
It's pretty frightening stuff and you could argue that all families could
potentially be a risk to their children and therefore all children in the UK
should be subject to a CP plan....?



If you had told us that these things can happen to a normal family a year ago we wouldn't of believed you.



Whilst we have been able to "forgive" the people who have treated us this way, it is unrealistic to think that we will ever forget how we were treated
and the implication this has for other families. We have been very open about
our experience with everyone that asks (school / family / friends / work /
strangers etc). Obviously it is still a rather taboo subject and the number of
party invitations our children get has noticeably reduced (quite understandable
really), but a little sad.



When all of this first started in July we felt there was no-one to turn to for support, certainly no one was explaining anything to us and keeping everything
secret. Your help and advice made such a huge difference, and I personally will
never forget how you treated us without
judgement
and how you explained how to get the patient files under
the data protection act. If it had not been for that one simple request to see
the medical records we may never of uncovered what was going on. Thank you!



Unfortunately I know in my heart that there are other families going through and will in the future be going through the same experience as us and it is this mainly that
drives us on to ensure all the mistakes are cleaned up. Our family has been incredibly
fortunate to have the love of our family, our education to seek out the
solutions and able to hire a solicitor to protect us. Clearly not all parents
will have all of this, but nonetheless this does not make them bad or unsuitable
parents, our hearts go out to these parents.



If you want I can send you a summary of our case, but the paperwork is now about 10KG! And in some ways it is unimportant, it is sufficient to say that after
speaking with you tonight it has highlighted that we must continue to put right
and challenge the areas that remain incorrect. I had originally thought that the
professional services would stick together and back each other up
(CYPS/police/NHS), however it seems the opposite has happened and they are
quite happy to wash their hands even if it means admitting the other party was
at fault. I can honestly tell you that some of the professionals
we have dealt with place the welfare of their own jobs higher than that of the
children they are employed to protect, this is and never will be acceptable!



We did use a local solicitor (Sue Ellingham) from http://www.hartnellchanot.co.uk/ in Exeter, the main reason was that they were the nearest recommended solicitor
that can do child law, they were able to attend the case conference and did
voice some opinions where they disagreed with some points of law / fact. They
have had some success at rectifying the records, but you are right it is very expensive
option and just keeping them up-to-date with the paperwork adds up pretty
quickly. In our case the addition of a solicitor for the second case meeting
made the doctor making the allegations change his mind and actually attend the
meeting in person (he had previously stated in a letter that he would not
attend) and the chair was very careful to ensure that the meeting was
accurately recorded.



I would strongly suggest to anyone that they should either record the meeting or if affordable have a solicitor, as our first meeting was recorded factually gross
errors and has taken a long time to rectify.



I can highly recommend the criminal law solicitor who provided me with free legal support when I was charged, Warren Robinson from Trinity Advocates (Exeter) tel 01392 927111. He can only do criminal
law
, which in my case I was being accused of common assault
of my daughter. He is very direct, to the point and brutally honest.



The paediatrician who made the false statements about my family to the police, CYPS and who later denied making the statements is Dr Quinn. However as we are
currently pursuing a complaint against him to his superiors I would prefer you
only keep his name for your personal information only. I will of course let you
know the outcome.



On a much lighter note I have attached a few recent-ish photo’s of our family, as you can see we have 3 beautiful girls, Isabel
(1), Rose (5), Victoria (7). My wife, Maria is expecting a boy in June, so we
are going to have our hands pretty full in 2010. And this is really what it is
all about – isn’t it? , keeping families together!
