So the Old DOLS System could be now replaced by a Liberty Protection Order.
Persons over the age of 18 or over, could be placed on a LPO, in their own homes.
The duty of the LA, will soon be left to Hospitals and Care homes, to make very important decisions.
This will give Care Home Managers the Power to make all the decisions of Residents, and they could exclude Relatives in some cases with regards to any input of the Procedure, if the Care Manager feels that it is not in the best interest of the Resident, and loved ones could even be prevented from visiting their loved one in the Care Home if he or her thinks it is in the Residents best interest not to see Relatives.
My Husband was recently in a Care Home for a short period, and lost mental capacity, he got out of the home one day and nearly got ran over by a car..
In her wisdom the Care Home Manager decided to put an emergency DOLS Application into the LA, without ever letting me know.
Not acceptable because i was Lasting power of attorney over my Husbands Health and Welfare and finances and Property.
I had to put several complaints in at the time regarding poor care, so with regards to this, in the new system she could of actually prevented me from seeing my Husband, if she thought that it was in his best interest, because i was challenging his standard of care at the time.
The future could be very worrying if Care Home Managers are given all the powers to make decisions about Residents, and they could exclude Family members from all decision making, if they again feel it is in the Residents best interest..
It will be a large learning kerb for all Organisations in Health and Social Care, as well as Family Carers, if they are looking after a Relative on a new LPO.
