A certain Police force that i will not mention who are failing Domestic violence victims tenfold.
They refuse to supply specialist Domestic Violence police officers to support victims.
I can vouch for this because they failed me personally.
Victims are very unsure of their Rights, and are often removed from their homes by the Police and placed in Domestic violence refuges, when i feel that the Perpetrator should be removed from a jointly owned property or council property.
I was always the one removed from my jointly owned property, while my abuser was left in the house.
In cases where children are involved their best interests should be the first concern, to get them into a place of safety.
Unknown to many victims, you have the right to go to the Court and fill in the Court forms, and supply as much evidence as you can, which may include Police reports, Social Work reports, Womensaid or Mensaid reports, these can be obtained under the Data Protection act.
Forms filled in, with evidence can be handed to the Court office, and Victims can in most cases see a Judge on the same day, ex parti, to get a non molestation restraining order with the power of arrest, at the same time an application for an occupation order of a jointly owned property can be applied for, which grants the Victim to remain in the property , while the perpetrator must remove themselves from the property or face arrest.
Another hearing with reference to the occupation order usually takes place within a few weeks for both Parties to give their evidence, and the Judge to make the decision,
It is of great importance that when a non molestation is granted, it is registered with the Police, or showed to the Police by the victim,especially if the document has the power of arrest on it,, the same goes with an Occupation order.
Domestic violence victims can put in an application for such orders without cost, if they have proven evidence of domestic violence.
Womansaid and Mensaid can be of very valuable support to domestic violence victims, and may be free to go to Court with victims.
If you go to Court make sure you get their early am, to fill in the Court papers to see a Judge on the same day.
You will also need to supply the Court with 3 of the same bundles, one for the Court, one for the perpetrator and one for yourself.
A Court bailif usually serves the order on the perpetrator , who then must stay away from the Victims abode, and even telephone calls are banned, and if breached can result in arrest.
