Social services under fire after boy placed into foster care before grandparents knew he was born

THE KINCARE CLAUSE, But very surprisingly not many LA, will even bother to considering using the clause.

But would rather place Children into Foster Care, more expense to the Taxpayers, as well as softening the child for Forced Adoption, a very lucrative business in the UK.

LA, have a mandatory obligation to consider using the Kincare Clause by placing a Child with an immediate Family,Member such as Grandparents, Aunties, Uncles, before a child is even placed with Foster Carers.

Non means tested Legal Aid is available to Family Members considering taking on the caring role, and can be made a party to the Public Law Care Proceedings.

But if Grandparents are slightly over the threshold for Public Legal Aid funding, by having savings,they will be denied Legal Aid, and would have to use their capital, to obtain Legal Representation, or put an Application in, as Litigant in Person.

If Family Members are granted a Special Guardianship Order, or are given, temporary ,care of a child, they in many cases are left with severe financial hardship, which could result in breakdown of a Special Guardianship if they are struggling financially.

Another serious issue surrounding Public Law Care Proceedings, at present is that Children are kept on a section 20 voluntary care order, for many years, this order should only be used as temporary.

I would advise all Parents to sign a section 20 order, out of duress by a Social Worker, because it will mean that you are agreeing to placing your child into care of the LA.and at this present time you will be denied Legal Aid.

Parents in these cases, are within their Rights to go and fetch their children from the Foster Carers.

But in most cases, the LA, would instigate an Emergency Protection Order, in this case Public Law Legal Aid will be granted.

Parents are not told that they have the right to try and get the order discharged within 72 hours, the same goes with a Police protection order.

Legal Aid is also available at the time, when Social Services send out a Pre Proceedings Letter,and this letter should be taken straight to a Solicitor.

There will then be a Pre Proceedings meeting, where you could be asked to sign an agreement to do certain things, to thus if the agreement is not breached , you may well be able to keep your child at home, this happens in a few cases..

But in many cases the child will be placed into Foster Care,

At this time, you could mention the kincare clause and Special Guardianship to the Social Worker, best to bur this in writing.

The Person wanting to take on the caring role, could also approach Social Services, and seek Legal Representation,.
